INFORMATION CLAUSE FOR GUESTS OF THE HOTEL AND "MAGNOLIA" RESTAURANT

In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (GDPR), we would like to inform you that:
  1. The administrator of your personal data is: HOTEL “MAGNOLIA” Bugajski Janusz, Szewce ul. Dewońska 15, 26-052 Sitkówka-Nowiny, NIP: 6571027308, REGON: 290280256 being the owner of the “MAGNOLIA” Hotel and Restaurant located in Zgórsko 90A, 26-052 Sitkówka- Nowiny.

  3. Your personal data is obtained directly from you, as well as from our partners from booking portals.
  4. The scope of your personal data processed depends on the stage and method of obtaining them, however, it never goes beyond the catalog: name and surname; address; e-mail adress; Phone number; PESEL number; tax identification number (if you want to receive an invoice); payment card number (for settlements only), vehicle registration number (when you use the hotel parking lot) and image (monitoring).
  5. Your personal data is processed for the purpose of:
  • to conclude and perform the contract to which you will be a party or to take action at your request, before concluding the contract – i.e. in order to book a service, its valuation, perform the service – art.6 ust.1 lit. b GDPR;
  • fulfillment of the legal obligation incumbent on the Administrator – e.g. in the field of issuing VAT invoices or fulfilling obligations resulting from tax regulations – art. 6 ust.1 lit. c GDPR;
  • the legitimate interest pursued by the Administrator, such as pursuing possible claims, ensuring your safety and securing property during the services provided by the Administrator, adapting the services provided to your personal preferences and in order to answer questions or provide information content, in the case of general inquiries, inquiries or inquiries submitted via the contact form – art.6 ust.1 lit. f GDPR.
  1. The administrator makes every effort to ensure all means of physical, technical and organizational protection of personal data against accidental or deliberate destruction, accidental loss, alteration, unauthorized disclosure, use or access.
  2. Your personal data is processed:
  • in order to perform the contract for the provision of hotel services, they will be stored as long as it is necessary to perform the contract, and after that time, for a period corresponding to the period of limitation of claims,
  • in order to fulfill the legal obligation incumbent on the Administrator, they will be kept for the time necessary to fulfill this obligation,
  • on the basis of the legitimate interest of the administrator, will be processed until an objection is effectively raised or the purpose of processing is achieved.
After these periods, your personal data will be deleted or destroyed.
  1. Your personal data may be transferred to:
  • entities authorized to obtain them on the basis of applicable law,
  • offices and bodies authorized to process data on the basis of specific legal provisions,
  • companies supporting the Administrator, among others in the field of accounting services,
  • entities processing data at the request of the Administrator for the purpose of debt collection,
  • payment institutions, including payment operators and intermediaries, banks,
  • companies providing hosting services for the Administrator in order to store personal data on the server,
  • entities operating the IT and teleinformation system of the Administrator.
The processing of personal data by such entities takes place only to the extent that it is necessary for the Administrator to conduct business or is required by law.
  1. Your personal data will not be transferred to a third country, they will not be subject to automated decision making, including decisions resulting from profiling.
  2. You have the right to:
  • access to the content of your personal data, rectification, deletion or limitation of processing;
  • object to the further processing of your personal data;
  • requests from the Administrator to transfer your data to another Administrator, if this does not adversely affect the rights and freedoms of other people.
  1. You have the right to lodge a complaint with the supervisory body, i.e. the President of the Personal Data Protection Office, when you feel that the processing of your personal data violates the provisions of the GDPR.

INFORMATION CLAUSE VISUAL MONITORING

In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (GDPR), we would like to inform you that:

  1. The administrator of personal data processed in the video monitoring process in the HOTEL building located in Zgórsko 90A, commune Sitkówka-Nowiny (hereinafter: “the Facility”) and in the area around the Facility is: HOTEL “MAGNOLIA” Bugajski Janusz Szewce, ul. Dewońska 15, 26-052 Sitkówka-Nowiny, NIP: 6571027308, REGON: 290280256.
  2. In the matter of exercising your rights regarding the protection of personal data, please contact us by phone: 41 366 79 12 or by e-mail: recepcja@hotelmagnolia.pl.
  3. Your personal data will be processed in order to observe and record an image of events in the Facility and around the Facility on the basis of a legitimate interest, i.e. pursuant to art. 6 sec. 1 lit. f. GDPR to ensure the protection of persons and property of the Administrator. Monitoring is not used to supervise the performance of work by employees.
  4. Your personal data will be stored for a period of 14 days. In the event that the image recordings constitute evidence in legal proceedings or the Administrator has learned that they may constitute evidence in the proceedings, this period shall be extended until the proceedings are legally concluded. After this period, the image recordings obtained as a result of monitoring, containing personal data, shall be destroyed, unless separate regulations provide otherwise.
  5. Your personal data will be made available only to entities authorized under the law.
  6. You have the right to access your data if it does not violate the rights of others, processing restrictions and the right to object to data processing.
  7. You have the right to lodge a complaint with the supervisory body, i.e. the President of the Personal Data Protection Office, when you feel that the processing of your personal data violates the provisions of the GDPR.

Information clause for job applicants

  3. Your personal data will be processed in order to carry out the current and (if consent has been granted) future recruitment.
  4. Legal grounds for processing:
    • With regard to the data indicated in the Labor Code: legal basis -> art. 6 ust. 1 lit. c) GDPR and the provisions of the KP, i.e. the employer’s obligation.
    • In terms of additional data provided by the Candidate with his consent (other data than indicated in the Labor Code): legal basis -> art. 6 ust. 1 lit. a) GDPR or art. 9 ust. 2 lit. a) GDPR, i.e. the Candidate’s voluntary consent, which may be revoked at any time.
    • For future Recruitment art. 6 ust. 1 lit. a) GDPR i.e. the Candidate’s voluntary consent, if given, which may be revoked at any time.
  5. Providing personal data specified in art. 221 § 1 Of the Labor Code is necessary to take part in the recruitment process. In the remaining scope, it is voluntary and does not affect the possibility of participating in the recruitment process.
  6. The recipients of your personal data may be entities providing e-mail hosting services through which the CV is sent.
  7. Your personal data will be processed by the Administrator for the duration of the current recruitment (including 3 months in which it is possible to select another selected candidate, in the event that it is necessary to fill the same position again), and in the field of future recruitment (if consent has been granted ) – for a further 12 months from the end of the current recruitment or without recruitment.
  8. You have the right to request access to the provided personal data, to rectify it and request its removal, as well as to request the Administrator to limit data processing, as well as to transfer it. You also have the right to withdraw your consent (to the extent it was submitted) at any time, the withdrawal of consent may take place by unilateral declaration and does not affect the lawfulness of the processing which was carried out on the basis of consent before its withdrawal.
  9. You also have the right to lodge a complaint with the supervisory authority, which is the President of the Personal Data Protection Office.
  10. In relation to the personal data provided, decisions will not be made in an automated manner.
